class=\"wp-block-paragraph\">Guidelines on Deinstitutionalization, Including in Emergencies\uff082022\u3000Committee on the Rights of Persons with Disabilities, CRPD\uff1a\u56fd\u9023\u969c\u5bb3\u8005\u6a29\u5229\u59d4\u54e1\u4f1a\uff09\u3092\u6307\u3059\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\uff08<a href=\"https:\/\/www.ohchr.org\/en\/documents\/legal-standards-and-guidelines\/crpdc5-guidelines-deinstitutionalization-including\">https:\/\/www.ohchr.org\/en\/documents\/legal-standards-and-guidelines\/crpdc5-guidelines-deinstitutionalization-including<\/a>\uff09<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u653f\u5e9c\u306b\u3088\u308b\u516c\u5f0f\u8a33\u304c\u306a\u3044\u306e\u3067\u3001\u3044\u3064\u3082\u901a\u308a\u539f\u6587\u306b\u3042\u305f\u308a\u306a\u304c\u3089\u3001\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\u304c\u7b56\u5b9a\u3055\u308c\u305f\u80cc\u666f\u3092\u6574\u7406\u3057\u3066\u3044\u3053\u3046\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Purpose and process<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These guidelines complement the Committee\u2019s general comment No. 5 (2017) and its guidelines on the right to liberty and security of persons with disabilities (art. 14). They are intended to guide and support States parties, in their efforts to realize the right of persons with disabilities to live independently and be included in the community, and to be the basis for planning deinstitutionalization processes and prevention of institutionalization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidelines draw on the experiences of persons with disabilities before and during the coronavirus (COVID-19) pandemic, which uncovered widespread institutionalization, highlighting the harmful impact of institutionalization on the rights and lives&nbsp;of persons with disabilities, and the violence, neglect, abuse, ill-treatment and torture, including chemical, mechanical and physical restraints, that they experience in institutions.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidelines are the result of a participatory process, which included seven regional consultations organized by the Committee. Over 500 persons with disabilities, including women with disabilities, girls and boys with disabilities, survivors of institutionalization, persons with albinism, grass-roots organizations and other civil society organizations participated.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\uff08Google\u7ffb\u8a33\u3082\u6d3b\u7528\u3057\u305f\u548c\u8a33\uff09<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u76ee\u7684\u3068\u30d7\u30ed\u30bb\u30b9<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u3053\u306e\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\u306f\u3001<a href=\"https:\/\/docs.un.org\/en\/CRPD\/C\/GC\/5\">\u59d4\u54e1\u4f1a\u306e\u4e00\u822c\u7684\u610f\u898b\u7b2c5\u53f7\uff082017\u5e74\uff09<\/a>\u304a\u3088\u3073<a href=\"https:\/\/www.ohchr.org\/Documents\/HRBodies\/CRPD\/14thsession\/GuidelinesOnArticle14.doc\">\u969c\u5bb3\u8005\u306e\u81ea\u7531\u304a\u3088\u3073\u5b89\u5168\u306b\u5bfe\u3059\u308b\u6a29\u5229\u306b\u95a2\u3059\u308b\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\uff08\u7b2c14\u6761\uff09<\/a>\u3092\u88dc\u5b8c\u3059\u308b\u3082\u306e\u3067\u3042\u308b\u3002\u672c\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\u306f\u3001\u969c\u5bb3\u8005\u304c\u81ea\u7acb\u3057\u3066\u751f\u6d3b\u3057\u3001\u5730\u57df\u793e\u4f1a\u306b\u5305\u6442\u3055\u308c\u308b\u6a29\u5229\u3092\u5b9f\u73fe\u3059\u308b\u305f\u3081\u306e\u7de0\u7d04\u56fd\u306e\u52aa\u529b\u3092\u5c0e\u304d\u3001\u652f\u63f4\u3059\u308b\u3053\u3068\u3001\u306a\u3089\u3073\u306b\u8131\u65bd\u8a2d\u5316\u30d7\u30ed\u30bb\u30b9\u65bd\u8a2d\u5316\u306e\u9632\u6b62\u3092\u8a08\u753b\u3059\u308b\u305f\u3081\u306e\u57fa\u790e\u3068\u306a\u308b\u3053\u3068\u3092\u610f\u56f3\u3057\u3066\u3044\u308b\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u3053\u306e\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\u306f\u3001\u65b0\u578b\u30b3\u30ed\u30ca\u30a6\u30a4\u30eb\u30b9\u611f\u67d3\u75c7\uff08COVID-19\uff09\u30d1\u30f3\u30c7\u30df\u30c3\u30af\u4ee5\u524d\u304a\u3088\u3073\u30d1\u30f3\u30c7\u30df\u30c3\u30af\u4e2d\u306e\u969c\u5bb3\u8005\u306e\u7d4c\u9a13\u306b\u57fa\u3065\u3044\u3066\u3044\u308b\u3002\u305d\u306e\u7d4c\u9a13\u306f\u3001\u5e83\u7bc4\u306a\u65bd\u8a2d\u5316\u3092\u660e\u308b\u307f\u306b\u3057\u3001\u969c\u5bb3\u8005\u306e\u751f\u6d3b\u3084\u6a29\u5229\u306b\u95a2\u3057\u3066\u65bd\u8a2d\u5316\u306e\u6709\u5bb3\u306a\u5f71\u97ff\u3092\u969b\u7acb\u305f\u305b\u305f\u3002\u66b4\u529b\u3001\u30cd\u30b0\u30ec\u30af\u30c8\u3001\u8650\u5f85\u3001\u4e0d\u5f53\u306a\u6271\u3044\u3001\u62f7\u554f\uff08\u5316\u5b66\u7684\u62d8\u675f\u3001\u6a5f\u68b0\u7684\u62d8\u675f\u3001\u8eab\u4f53\u7684\u62d8\u675f\u3092\u542b\u3080\uff09\u3001\u969c\u5bb3\u8005\u305f\u3061\u306f\u3001\u305d\u308c\u3089\u3092\u65bd\u8a2d\u306e\u4e2d\u3067\u4f53\u9a13\u3057\u305f\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u672c\u30ac\u30a4\u30c9\u30e9\u30a4\u30f3\u306f\u3001\u59d4\u54e1\u4f1a\u304c\u4e3b\u50ac\u3057\u305f7\u56de\u306e\u5730\u57df\u5354\u8b70\u3092\u542b\u3080\u53c2\u52a0\u578b\u30d7\u30ed\u30bb\u30b9\u306e\u6210\u679c\u3067\u3042\u308b\u3002\u969c\u5bb3\u306e\u3042\u308b\u5973\u6027\u3001\u969c\u5bb3\u306e\u3042\u308b\u5c11\u5e74\u5c11\u5973\u3001\u65bd\u8a2d\u53ce\u5bb9\u306e\u88ab\u5bb3\u8005\u3001\u30a2\u30eb\u30d3\u30ce\u306e\u4eba\u3001\u8349\u306e\u6839\u56e3\u4f53\u3001\u305d\u306e\u4ed6\u306e\u5e02\u6c11\u793e\u4f1a\u56e3\u4f53\u3092\u542b\u3080 Institutionalization of persons with disabilities refers to any detention based on disability alone or in conjunction with other grounds such as \u201ccare\u201d or \u201ctreatment\u201d. Disability-specific detention typically occurs in institutions that include, but are not limited to, social care institutions, psychiatric institutions, long-stay hospitals, nursing homes, secure dementia wards, special boarding schools, rehabilitation centres other than community-based centres, half-way homes, group homes, family-type homes for children, sheltered or protected living homes, forensic psychiatric settings, transit homes, albinism hostels, leprosy\u3000 colonies and other congregated settings. Processes of deinstitutionalization should be led by persons with disabilities, including those affected by institutionalization, and not by those involved in managing or perpetuating institutions. Investments in institutions, including renovation, should be prohibited. Investments should be directed towards the immediate release of residents and the provision of all necessary and appropriate support for living independently. States parties should provide persons with disabilities, including children with disabilities, leaving institutions with a comprehensive compensatory package comprising goods for daily living, cash, food vouchers, communication devices and information about services available, immediately upon departure. Such packages should provide basic security, support and confidence to persons with disabilities leaving institutions, in order that they can recover, seek support when they require it, and have an adequate standard of living in the community without risk of homelessness or poverty.<\/p>\n\n\n\n<p
